Terms and Conditions of Use

1. Your use and/or order and/or purchase is made on the basis of the terms outlined here in full. They may not be modified or altered in any way.

2. Your use and/or order and/or purchase are governed by the Laws of Queensland. Each party unconditionally submits to the jurisdiction of the State of Queensland, Australia only.

3. You warrant that the details you provide for the purposes of this web site are correct.

4. If you are acting on behalf of a company or as an agent you warrant that you have actual authority to enter into this agreement. You indemnify all actions against Ecospecifier Pty Ltd trading as Ecospecifier International (hereinafter 'Ecospecifier') if it is found that you do not have the required authority.

5. By entering this site and this agreement you give your express approval to Ecospecifier's use of cookies in enabling the operation of the site as outlined in the Privacy and security statement.

6. Ecospecifier will treat as private any information that you submit in the course of your dealings with Ecospecifier through the web site in accordance with the Privacy and Security statement. Ecospecifier will not deal with your provided information except as is required to process your order and purchase and as Ecospecifier is otherwise required to deal with your information as required by law.

7. You agree to the cost, indicated as the subscription figure, in UAE Dirhams or Australian Dollars (AUD) as is outlined in ‘Subscribe to ecospecifier’ internet site page.

8. Your selection of item/s that you have identified on the ‘Subscribe to ecospecifier’ facility is at law considered to be an invitation to treat. An offer is constituted, on the terms outlined in this statement, on the basis of your selection and the indicated total purchase price. Your acceptance will be indicated by you filling in your credit card details or forwarding payment in another form. By undertaking these actions you indicate your intention to accept these terms and conditions as part of your order and purchase.

9. Once your acceptance is communicated to Ecospecifier you will be required to complete the transaction by authorising Ecospecifier to debit your account according to the stipulated price in the ‘Subscribe to ecospecifier’ internet site page according to your organisation's turnover.

10. Ecospecifier , its directors, agents, representatives or staff  accept no liability whatsoever for any loss whether caused directly or indirectly through the use of this web site or through contracting with Ecospecifier over the Internet, fax, phone or email. You agree to assume the full risk of contracting with Ecospecifier over the Internet,fax, phone or email and indemnify Ecospecifier against any and all losses you incur.

11. Ecospecifier, its directors, agents, representatives or staff, accept no liability whatsoever for any actions by third parties that interfere with this transaction. You acknowledge that technical difficulties may interfere with the operation of this transaction and assume this risk in accepting this offer.

12. If by reason of any fact or circumstance, matter or thing beyond the reasonable control of Ecospecifier or you as the purchaser, either is unable to perform in whole or in part any obligation under this agreement that party is relieved of that obligation under this agreement to the extent and for the period that it is so unable to perform and is not liable to the other party to this agreement in respect of such inability.

13. If any provision of these terms and conditions is deemed to be illegal, invalid, void or voidable, the validity of the remainder of the terms and conditions will not be affected and will continue to be in force and have effect.

14. Where the company has static IP address(es) it is a condition of purchase to provide these to Ecospecifier for the purposes of login identification.

15. Total Company Turnover is defined as the gross Earnings Before Income Tax (EBIT) of the entire organisation and all divisions and wholly or partly owned subsidiaries or parterships of the trading entity within the country/countries for which subscription/s has been purchased.

16.   It is a condition of purchase that login details are not shared outside the licence conditions even within a subscribing organisation or with any third parties. Doing so may invoke legal action to the full extent of the law and immediate cancellation of existing subscription without refund of the outstanding fees. For a significant breach,  Ecospecifier thereafter reserves the right to not re-subscribe the company.

17.  Product suppliers, manufacturers, agents or their representatives  are not permitted to use the inclusion of their products/s' inclusion in  Ecospecifier as a promotion of the  environmental preferability of their products or service in any form of advertising, marketing or promotion without the express written permission of ecospecifier.

18. Failure to comply with this condition may result in all that company's product and manufacturer/supplier listings being immediately removed from the website. Furthermore manufacturers and suppliers agree to indemnify Ecospecifier against the full legal costs associated with any remedy or action that may be required to ensure unauthorised material in any form is removed from the marketplace whatever the form of publishing. For a significant breach,  Ecospecifier thereafter reserves the right to not re-publish the company's products or contact details .
